This is the opinion of one person who has been blogging a long time, and working with other bloggers for almost as long.<\/span><\/i>\n\n<span style=\"font-weight: 400;\">As bloggers, many of us have shared this experience: You&#8217;re cruising around the internet and then happen upon your <\/span>OWN post or your OWN image on someone else\u2019s site!\n\n<!--more-->\n\n<b>This is always jarring, but what do you do about it?<\/b>\n\n<span style=\"font-weight: 400;\">Likely, the best answer is&#8230; nothing. <\/span>I can hear the gasps from those of you wanting to take DMCA-related action. I get it, but I want you to try and see a different perspective.\n<h2><strong>What is DMCA?<\/strong><\/h2>\n<span style=\"font-weight: 400;\">DMCA stands for the <\/span><b>Digital Millennium Copyright Act<\/b><span style=\"font-weight: 400;\">, a U.S. copyright law giving citizens the ability to file a claim against someone violating their copyright and getting that content taken down.<\/span>\n\n<span style=\"font-weight: 400;\">Again, not a lawyer, but you can <\/span><a href=\"http:\/\/www.copyright.gov\/legislation\/dmca.pdf\" target=\"_blank\" rel=\"noopener noreferrer\"><span style=\"font-weight: 400;\">read all about it here<\/span><\/a><span style=\"font-weight: 400;\">.&nbsp;<\/span>\n\n<img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-mv_create_no_ratio wp-image-8792\" src=\"https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/12\/laptop-typing-735x491.png\" alt=\"birds eye view of a man's hands typing on a laptop computer\" width=\"735\" height=\"491\" srcset=\"https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/12\/laptop-typing-735x491.png 735w, https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/12\/laptop-typing-441x294.png 441w, https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/12\/laptop-typing-768x513.png 768w, https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/12\/laptop-typing-689x460.png 689w, https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/12\/laptop-typing.png 800w\" sizes=\"auto, (max-width: 735px) 100vw, 735px\" \/>\n<h2><strong>How do bloggers use the DMCA?<\/strong><\/h2>\n<span style=\"font-weight: 400;\">In the blogging world, people file DMCA claims against various entities in several types of circumstances. <\/span><span style=\"font-weight: 400;\">Among them:&nbsp;<\/span>\n<h3><b>1. Content Scrapers<\/b><\/h3>\n<span style=\"font-weight: 400;\">Content scrapers are websites that crawl, or scrape, your entire post <\/span><span style=\"font-weight: 400;\">and republish it \u2014 obviously without permission. <\/span>\n\n<span style=\"font-weight: 400;\">Sometimes, this includes a <a href=\"https:\/\/www.mediavine.com\/backlinks-inbound-links-seo\/\">backlink<\/a> to you and sometimes it does not, but that token credit has nothing to do with the <\/span><b>legality<\/b><span style=\"font-weight: 400;\"> of posting someone else\u2019s content on your site.&nbsp;<\/span>\n\n<span style=\"font-weight: 400;\">It has everything to do with whether or not you want to begin the process of getting it removed. <\/span>\n\n<span style=\"font-weight: 400;\">B<\/span><span style=\"font-weight: 400;\">ottom line:&nbsp;<\/span>\n\n<em><strong>You always need permission to publish someone else&#8217;s content. If you&#8217;re using other people&#8217;s content, to truly cover your bases, this permission should be written.&nbsp;<\/strong><\/em>\n\n<span style=\"font-weight: 400;\">Of course content scrapers don\u2019t care about laws or permission, because they&#8217;re by definition lifting content without permission. As such, these are cases where DMCA can be strongly considered.<\/span>\n\n<span style=\"font-weight: 400;\">With that said, there&#8217;s a distinction between taking action in response to flagrant cases and proactively going hunting for stolen content with the intent of filing DMCA takedown requests.&nbsp;<\/span>\n\n<span style=\"font-weight: 400;\">Why? What&#8217;s the difference?<\/span>\n\n<span style=\"font-weight: 400;\">Honestly, it comes down to time and resources. There are only so many hours in the day and if something&#8217;s taking away from work you could be doing on your site, it should be worthwhile.<\/span>\n\n<span style=\"font-weight: 400;\"> It is my strong belief that in almost all instances, your time is better spent creating new content, improving old content or promoting existing content than chasing down content thieves.&nbsp;<\/span>\n\n<span style=\"font-weight: 400;\">Yes, those thieves deserve all the shaking-fist emojis in the world, and of course there are exceptions where you should act. But by and large, those exceptions are few and far between.<\/span>\n<h3><b>2. Unauthorized Roundups&nbsp;<\/b><\/h3>\n<span style=\"font-weight: 400;\">Back in the days of yore (the early-mid &#8217;00s), roundups used to be a thing.<\/span>\n\n<span style=\"font-weight: 400;\">People didn\u2019t think about permissions, copyright or any of that in the wild western frontier of Ye Olde Internet. That time has long passed. Anytime bloggers want to use other people&#8217;s content or images, for whatever reason, they need to reach out.<\/span>\n\n<span style=\"font-weight: 400;\">Typically this permission is granted via Facebook roundup request groups.<\/span>\n\n<strong><em>If you have participated in roundup groups and given permission for your content to be included in them, you should NOT be filing DMCA requests for websites who use your content.<\/em><\/strong>\n\n<span style=\"font-weight: 400;\">If you are in a roundup group and find links on a request that isn&#8217;t yours, don&#8217;t use those links without permission. The permission in these groups is not given on a blanket, carte-blanche basis. <\/span>\n\n<span style=\"font-weight: 400;\">It is specific to the site that\u2019s asking for links. <\/span><span style=\"font-weight: 400;\">If you are a person that is very sensitive to the use of your content, you should probably not be submitting to roundup groups at all.<\/span>\n\n<span style=\"font-weight: 400;\">Regardless, keep a list of posts you\u2019ve granted permission for, and to whom. Reach out to them, or ditch the roundups if they&#8217;re more trouble then they&#8217;re worth, but table that DMCA request.<\/span>\n<h3><b>3. Pin Thievery&nbsp;<\/b><\/h3>\n<span style=\"font-weight: 400;\">This is a hot topic in the blogging world currently.<\/span>\n\n<span style=\"font-weight: 400;\">People are routinely reporting <a href=\"https:\/\/www.mediavine.com\/pinterest-newest-features\/\">Pinterest pins<\/a> that are stolen \u2014 and various advice surrounding this practice and what to do about it. It has become widespread, and advice differs greatly depending on who you ask.&nbsp;<\/span>\n\n<span style=\"font-weight: 400;\">Whether or not you should search for and pursue stolen pins is a <\/span><i><span style=\"font-weight: 400;\">very<\/span><\/i><span style=\"font-weight: 400;\"> personal decision, and is different than filing a DMCA with a <a href=\"https:\/\/www.mediavine.com\/learn-about-web-hosting\/\">hosting company<\/a> to take them down \u2014 which is another step entirely.&nbsp;<\/span>\n\n<span style=\"font-weight: 400;\">My personal opinion that this is largely the same as the rest. Your time is likely better spent elsewhere. If you devote more than<\/span> 15-20 minutes a week to this task, it&#8217;s probably too much.\n\n<img loading=\"lazy\" decoding=\"async\" class=\"aligncenter wp-image-7588 size-full\" src=\"https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/08\/pinterest-computer.png\" alt=\"A laptop with notebook open in front of it.\" width=\"800\" height=\"533\" srcset=\"https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/08\/pinterest-computer.png 800w, https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/08\/pinterest-computer-441x294.png 441w, https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/08\/pinterest-computer-768x512.png 768w, https:\/\/www.mediavine.com\/wp-content\/uploads\/2018\/08\/pinterest-computer-690x460.png 690w\" sizes=\"auto, (max-width: 800px) 100vw, 800px\" \/>\n<h2><strong>Should I Talk to a Lawyer About DMCA?<\/strong><\/h2>\n<span style=\"font-weight: 400;\">To recap, copyright infringement is a serious <a href=\"https:\/\/www.mediavine.com\/interview-jamie-lieberman\/\">legal matter<\/a>, and if you believe your business is being legitimately hurt as a result of it, you should reach out to a lawyer with questions.<\/span>\n\n<span style=\"font-weight: 400;\">The DMCA is also a serious matter, and should be used intentionally and responsibly. It&#8217;s there for an important reason, but that doesn&#8217;t mean it&#8217;s the only solution to every problem.<\/span>\n\n<span style=\"font-weight: 400;\">If you are spending significant amounts of time thinking about this, I\u2019d encourage you to weigh the benefits of taking legal action instead of focusing on content and audience curation.<\/span>\n\n<span style=\"font-weight: 400;\">Content scrapers rarely stick around long, because scraping is a flawed model. These sites rarely threaten your <a href=\"https:\/\/www.mediavine.com\/what-is-a-keyword\/\">SEO results<\/a>. Google is smart enough to know <a href=\"https:\/\/www.mediavine.com\/what-is-content-syndication\/\">which post is the original<\/a>. <\/span>\n\n<span style=\"font-weight: 400;\">Your feelings on the subject are legitimate, and please know I share them. <\/span>\n\n<span style=\"font-weight: 400;\">But putting emotions aside can yield better results in terms of <a href=\"https:\/\/www.mediavine.com\/3-action-items-that-will-get-you-massive-traffic\/\">traffic<\/a> and <a href=\"https:\/\/www.mediavine.com\/how-do-i-improve-my-rpm\/\">revenue growth<\/a> in the long haul.\n<\/span><\/section>\r\n\r\n\r\n\r\n<section class=\"wp-block-group has-global-padding is-layout-constrained wp-block-group-is-layout-constrained\" style=\"margin-top:0\">\r\n<div class=\"wp-block-group has-global-padding is-layout-constrained wp-container-core-group-is-layout-09aec4f2 wp-block-group-is-layout-constrained\"
